RELEASE, WAIVER, ASSUMPTION OF RISK AND INDEMNITY

As lawful consideration for my child being permitted to participate in the Terpsichore Dance Celebration Inc. Event I agree that neither myself nor anyone associated with my child will make a claim against, sue, attach the property of or prosecute Terpsichore Dance Celebration Inc., its Owners, Employees, Staff, Partners, Clients and all others associated with the Event, for damages, death, illness, infection, personal injury or property damage which my child may sustain as a result of my child's participation. This Release is intended to discharge in advance all members of Terpsichore Dance Celebration Inc., its Owners, Employees, Staff, Partners, Clients and all others associated with the Event against any and all liability, including negligent actions or inaction, arising out of or connected in any way with my child's participation.

I warrant that my child is in good health and proper physical fitness to enable participation in the Event and any activities associated with the Event.  I understand that the Event involves physical activity and close proximity to other participants, and that participants in such Events occasionally sustain serious personal injuries (including death) and/or property damage, as a consequence thereof.

I acknowledge that participation in such Event by my child involves possible exposure to and illness from infectious and/or communicable diseases including, but not limited to, COVID-19, MRSA, Influenza, and other communicable diseases. I further acknowledge that Terpsichore Dance Celebration Inc. has put in place preventative measures to reduce the spread of COVID-19 and I fully understand that any preventative measures are not 100% effective to prevent infection.  While adherence to rules and requirements may reduce the risk of possible exposure, there is still a risk of serious illness and death.

Knowing the risk of participation, nevertheless, I hereby agree that participation is voluntary and on behalf of my child, I knowingly and freely assume full responsibility of all such risks, both known and unknown, and waive, release fully and forever discharge, indemnify and hold harmless, Terpsichore Dance Celebration Inc. its Owners, Employees, Staff, Partners, Clients and all others associated with Event, who (even if arising through negligence or carelessness) might otherwise be liable to me for damages.

I hereby waive, release fully and forever discharge, indemnify and hold harmless Terpsichore Dance Celebration Inc., its Owners, Employees, Staff, Partners, Clients and lessors of premises used to conduct the Event in which my child participates, on behalf of my child, myself and my heirs, assigns, next of kin and personal representative, from and against any and all causes of action, demands, claims of whatever type or kind including any illness, injury, death, disability, or other loss, damages, costs, expenses and compensation for damage or loss to my child, myself and/or personal property that may be caused by any act, or failure to act, whether arising from the negligence of Terpsichore Dance Celebration Inc., its Owners, Employees, Staff, Partners, Clients and lessors of premises used to conduct the Event in which my child participates or otherwise to the fullest extent permitted by law.

Further, I expressly agree that this Release, Waiver, Assumption of Risk and Indemnity is intended to be as broad and inclusive as permitted by the laws of the Province of Ontario or any other province in which my child may participate in an Event described herein, and that if any portion of this Release, Waiver, Assumption of Risk and Indemnity is determined to be invalid, it is agreed that the remaining provisions of this Release, Waiver, Assumption of Risk and Indemnity shall continue in full force and effect.  I further agree that any and all disputes arising under this agreement, whether as to interpretation, performance or otherwise, shall be subject to the exclusive jurisdiction of the courts of the Province of Ontario and each of the parties hereto hereby irrevocably attorns to the jurisdiction of the courts of such province.

I have carefully read this Release, Waiver, Assumption of Risk and Indemnity and I fully understand all of its terms, my rights, and my obligations herein.  I voluntarily give my consent, sign freely and declare that I was not induced or coerced into signing this form.
